This Regional Act aims at preventing the loss of land caused by urbanization and infrastructure growth. The Act aims at ensuring that explotation of land is carried out in a sustainable manner, by preserving the environment and respecting agricultural activities.
The aim of this Act is the promotion and development of green spaces in urban areas. The Municipalities shall be responsible for developing urban green spaces within their territories, whilst a special committee under the Ministry of the Environment shall exercise monitoring functions.
These provisions lay down some amendments and addenda to Regional Act No. 56 of 1977 on land use and preservation. The amendments concern the instruments for planning the use of agricultural and urban land and protecting landscapes.
The present Regional Act makes provision in matter of land use planning and land protection. It regulates the exercise of the relevant administrative functions by the competent authorities.
The present Act provides for the protection of the territory of the Emilia Romagna Region by making rules on land use planning. Cooperation among the Region, the Provinces and the Communes in the field of land use planning and programming is hereby encouraged.
It is hereby laid down the regional legislative framework in matter of territorial use, management and planning. The overall objective pursued is sustainable development in the management of the regional territory.
This Decree regulates the procedure to be followed for the issue of authorizations required prior to any intervention or modification on landscapes. This authorization must be obtained by owners and holders of lands.
This Regional Act supplements Regional Act No. 11 of 2004 on town and country planning by inserting new provisions governing landscape protection. These provisions are adopted in compliance with those laid down at the national level under the Code on Cultural Heritage and Landscape.
