    This Act establishes a Small Claims Tribunal, defines its jurisdiction and provides rules relative to proceedings of the Tribunal. The Tribunal shall have no jurisdiction in respect of any claim: (a) for the recovery of land or any estate or interest in any land; (b) in which the title to any land, or any estate or interest in any land is in question; (c) in which there is a dispute concerning the entitlement of any person under a will, or settlement, or on any intestacy (including a partial intestacy); (d) for any chiefly or other traditional or customary title.

    This Act makes provision for the registration of National Land, i.e. any land declared under this Act to be National Land. The Act also makes provisions for certain matters in relation with the acquisition of land by the State for public purposes.The Minister may declare, by Notice, a land to be National Land if the land, in the opinion of the Minister was acquired by a previous administration or required for a public purpose as defined by this Act or “a reason that is reasonably justified in a democratic society that has a proper regard for the rights and dignity of mankind”.

    This Act concerns the abolition on certain restrictions concerning trusts and provides rules for the creation in Nauru of a trust in perpetuity or for any lesser duration. This Act shall not apply to any settlement, disposition or trust of any land or of any interest in any land where such land is situated in Nauru. The Act also concerns grant of administration of a foreign will or estate. Executors of a foreign will or administrators of a foreign estate shall be a trustee corporation.

    The Traditional Rights Court shall consist of a permanent panel composed of a Chief Judge and two other judges, and such other members or panels as may be appointed or constituted from time to time as provided for by Section 4 of this Act. The Commission may, for reasons which, in its opinion, are sufficient, suspend or remove any member of the Court or take such other disciplinary action against him oe her as it may deem necessary.

    The National Conservation Council is established under section 4. The Council shall advise the Minister on (establishment of) Conservation Areas and advise the Minister on the formulation of rules applicable to conservation areas, and on the administration and control of conservation areas and carry out other functions set out in section 9.

    This Act repeals the Land Tribunal Act. Vanuatu enacted on 16 January 2014 the Custom Land Management Act 2013, which assigns a role in customary land disputes to nakamals and custom area land tribunals.
