    There is hereby laid down the legislative framework in matter of town and country planning, in compliance with the principles of subsidiarity, cooperation and sustainability. The regional territory shall be managed through plans approved at the municipal, provincial and regional levels. In order to ensure the coordination of such different plans, article 3 provides for the setting up of the integrated Regional Territorial System. Plans shall be subjected to environmental assessments, so as to contribute to the protection of the environment and regional landscape.

    The present Regional Act lays down the legislative framework in matter of town and country planning, taking into particular consideration, inter alia, the need to preserve the environment and regional landscape, including agricultural lands. The regional territory shall be managed at the municipal, provincial and regional levels. Plans shall be coordinated as provided in article 4. Article 47 concerns the environmental assessment of plans.

    Pursuant to article 21 of Regional Act No. 26 of 2003, the present Regional Regulation lays down the expropriation procedure applicable to polluted areas that are to be subjected to rehabilitation interventions. The person who is liable for the environmental damage shall be charged with the cost of rehabilitation measures.

    The present Regional Act provides for the setting up of rural districts, as defined by article 2, which are intended to promote the development and proper management of areas where agricultural activities are carried out. Rural districts shall be delimited by the Regional Council (art. 4), whereas the provinces shall be in charge of the elaboration and approval of their respective plans (art. 5).

    The present Regional Act, in compliance with the provisions contained in Act No. 183 of 1989 and Act No. 36 of 1994: (a) lays down rules governing the establishment of basins; (b) provides for the delimitation of areas of soil protection; (c) defines the procedures to be followed to adopt river basin plans; (d) aims at the protection and preservation of water resources.

    This Regional Act aims at ensuring the rational use of water resources, soil conservation, rural development and improvement of agricultural production by laying down the legislative framework concerning land reclamation. The regional territory is divided into different districts for the purpose of planning, performing and managing land reclamation. The interventions to be undertaken are listed out in article 5. The Regional Council shall adopt the regional land reclamation programme in accordance with article 8.

    By way of implementation of Directive 96/61/EC, this Legislative Decree aims at the integrated prevention and control of pollution which arises from the activities specified in Annex I. There are established particular measures intended to prevent and reduce emissions into the air, water and land, comprising general principles in matter of waste management. Furthermore, the Legislative Decree regulates the issue and renewal of the environmental integrated authorization which is required for the installations mentioned in Annex I.

    In compliance with the principles and rules laid down in Directive 96/61/EC, this Regional Act makes provision on integrated pollution prevention and control, with a view to securing a high level of protection of human health and the environment. In particular, the Act lays down rules governing the issue and renewal of the integrated environmental authorization of existing and new installations (those mentioned in Annex I to Directive 96/61/EC).

    In implementation of articles 17, 19 and 21 of Legislative Decree No. 22 of 1997, the present Regional Act lays down rules governing the environmental restoration of areas which have been polluted by waste. Furthermore, it makes provision on the elaboration of the Land Reclamation Plan (art. 3). Article 2 provides for the creation of the register of areas to be restored.
