    Guaranty of security of juridical act about lands is a more important difficulties in every country. Disregarding the independence of land registration system from the system of civil law and disregarding bases and functions of land registration system has resulted in making mistakes by judicial doctrine and precedent in order to propose proper suggestions for solving the problems related to land registration system and to sanction for juridical acts about lands.

    the system of land registration is protective formalism that is formed based on the theory of “public confidence”. This theory presumes that what reflected by the land registration offices is based on the legal fact. This theory, which provides legal stability and security in transactions, is manifested in three guiding principles including “mirror principle”, “curtain principle” and “insurance principle”, and offers an “abstractive description” to a land registration system.

    Note7: This note indicates that Ministry of Jihad-e-Agriculture shall issue permits for any exploitation of natural dense forests and rangelands. Priority, on the basis of technical guidelines, shall be granted to those individuals in possession of livestock grazing permits and those using Forests and Rangelands in each region. The Ministry of Jihad-e-Agriculture shall fix yearly the basic price for forests and rangeland derived products.

    The amendments concern the need for authorization from the Ministry of Natural Resources and Agriculture for the conversion of forest and valley land into the following: 1. making farmland, orchard, rangeland, artificial forests, forage land, livestock institutions, aquatic breeding institutions, as well as the use for mine exploting and exploration (in nothern Iran); and 2. establishment of factories, townships, schools, training institutions, sport clubs, etc.

    Chapter one of this Law contains definitions of terms therein employed, such as: forest, forest bushes, desert shrubs, forest cover and regions, range, planted rangeland, logs and saplings. Chapter two sets out rules for exploitation and protection of the above mentioned areas. Forestry Organization, established within the Ministry of Agriculture, shall supervise and issue permits for each applicant regarding exploitation of these areas. Licence shall be valid up to one year.

    The purpose of this Act is to regulate provisions regarding transfer of lands to individuals in order to make efficient use of water and fertile soil, as well as leading the country to self-sufficiency. In particular, it should be noted that rights of the people on fruitful lands should be respected. Exploitation of the natural woods and forests are exclusive rights of the Government. The Government may assign abandoned lands to individuals for agricultural purpose. Indigenous people and persons with knowledge in agriculture are considered as a priority.

    The present Law introduces some amendments to the Law of 16 October 1979 on Assignment and Reclamation of Lands in the Islamic Republic of Iran. In particular, the amendments consists of detailed provisions on types and size of lands, formation of the decision making council, dispute settlement as well as specific terminology on the subject.

    The purpose of this Regulation, which consists of 2 articles, is to amend the Law of 15 May 1960 on Land Reform in few detailed provisions, as well as add supplementary provisions to the Law. The Regulation obliges the land owners as well as authorities to prepare the official documents of ownership for transferred land.

    The purpose of this Act is to regulate general principles governing the limits of ownership of lands by individuals in the country. In particular, no one may own more than a certain amount of land in the whole country. Any land in excess shall be seized by the Government and redistributed. Fruit and tea gardens, as well as agricultural land are exempt from this limitation. Abandoned land, wasteland and land exceeding the maximum permitted, are considered eligible for division and redistribution. According to the Act, farmers are considered as priority in land redistribution.
