    Customary land tenure is normally not based on codified or statutory sources, but stems from customary traditions and norms. When westernised courts have to interpret and adjudicate these customary traditions and norms, the normal rules of statutory interpretation cannot be followed.

    This Ordinance of the Governor of Sint Maarten provides rules relative to matters of inheritance. It replaces completely book 4 and title 3 of Book 7 of the Civil Code. It concerns inheritance based on will an intestate. Various provisions concern rights in land, including usufruct and lease of land. Donation shall be effected by notarial deed.

    This Decree establishes a public corporation that shall be responsible for waste collection and processing in Aruba and the maintenance of all public land. The corporation shall be managed by a council and a director. It shall observe in its operations all existing environmental norms.

    This Ordinance establishes the Council for Physical Development and provides rules for town and country planning and development in general in Aruba. The Minister shall prepare a Physical Development Plan, which contains general indications of proposed development. The Plan shall be adopted by State Decree. Directives based on the Plan may determine which development activities may be carried out only with an authorization of the Minister. Such activities may include the mining, the felling of trees, afforestation and cultivation of land and the establishment of waste reception facilities.

    Section 11 forms part of first paragraph (entitled “Hereditary lease”) which forms part of the third Chapter entitled “Granting of rights in respect of lands of the domain”. Section 11 regulates the use of plants and trees present on the public lands tenured in long-term lease. The tenant has the free right of exploitation or other use of trees and plants if not otherwise expressly provided in the hereditary lease order and subject to payment to the President of charges for the logging of valuable timber species.

    The land tenant shall be allowed to freely use of plants and trees that are planted by others, as far as such use is not excluded in the allocation order and subject to payment imposed by laws for the logging for other purposes than own use. If on the land timber is processed or balata or other forest products are exploited, except for own use, the tenant shall be subject to payment of such levies and charges as are applicable to such activities on land of the domain, except in case of exemption pursuant to a concession.
