On 27th August 2010, Kenya’s new constitution was promulgated. This set in place a process of implementation through the enactment of different legislations and setting up of new institutional frameworks as envisaged in the new constitutional dispensation. For the land sector, far reaching legal and institutional reforms are envisaged in Chapter 5 of the constitution. The Chapter on Land and Environment also lays out broad principles through which land and the environment shall be managed.

Despite a history of more than 100 years and the introduction of provisional maps to support land registration, the Kenyan cadastre is largely incomplete. It consists of a patchwork of maps of different positional qualities, which would not be readily integrated to create a nation-wide coverage. This paper outlines the structure of the Kenyan cadastre and analyses the quality of the cadastral maps with regard to the requirements of modern land administration.

Dispute resolution is a key component of land administration and management in Kenya. Article 162 of the Constitution of Kenya provides for the establishment of the Environment and Land Court (ELC) by an Act of Parliament. Further, parliament is mandated to determine the jurisdiction and functions of the courts. In 2011, parliament passed the Environment and Land Court Act through which the Environment and Land Court was established. In accordance with the provisions of this act, the court is mandated to ensure reasonable and equitable access to its services in all counties.

Public land is a resource that should be effectively managed in the public’s best interest in line with provisions of the Constitutions of Kenya and the Land Act. The management framework governing land use and development decisions on public land should ensure protection and sustainable management of the land. Despite these provisions in law, recent media reports point toresurgenceof public land grab. The Land Development and Governance Institute commissioned this research study to establish the status of the public land management in Kenya.

Land acquisitions, either driven by foreign investments or domestic investment needs have continued to polarize opinions. When this research was proposed, it was premised on arguments by scholars Ruth Meinzen-Dick and Helen Markelova, who had analysed agricultural land deals, and argued that there were potentially two schools of thought about foreign acquisitions over agricultural land.
