    Land consolidation is a highly effective land management instrument that allows for the improvement of the structure of agricultural holdings and farms in a country, which increases their economic and social efficiency and brings benefits both to right holders as well as to society in general. Since land consolidation gives mobility to land ownership and other land rights, it may also facilitate the allocation of new areas with specific purposes other than agriculture, such as for public infrastructure or nature protection and restoration.

    This Law 49/2016 amends articles 5, 7, 14, 24, 26, 29 and 31 of Law 9693 of 2007. The amendments concern the ownership of the pasture fund now divided into a) the state pasture fund consisting of the pasture and lawns owned by the municipality managing their territory; and b) the private pasture fund consisting of the pasture and lawns in private property.The line ministry is the responsible authority for the protection and administration of the pasture fund in the protected areas.

    Regulation 435 of 2016 amends and supplements certain definitions laid down in Regulation 1347 of 2008 as well as its sections 7, 12, and 17. According to the amendment, the line Ministry has to request a technical report from the municipality within one week of an application submission while the municipality has to respond and prepare a technical report within 10 days of the request. Further, the value of the removed pasture area has to be paid in full before the approval is issued.

    This Guideline lays down the technical criteria used for the classification of pasture and meadows as well as the procedures to be followed for leasing pasture and meadow areas to individuals or private entities. The classification is used for the preparation of management plans, the update of the pasture cadaster, and the lease contracts with private users. The leasing is done in accordance with the management plans and the rules of protecting pasture ecosystems and the sustainable development of pasture resources.

    The Guideline provides for areas of the public forestry and pasture fund that may be leased according to the public competition/bidding procedures. The forestry authorities assess the forestry and pasture areas at the beginning of the year and submit the proposed list of leases to the municipality together with a detailed report on their potential use. The leases should comply with the law requirements regarding the allowed activities as well as the long- and short-term management plans.

    This Regulation amends articles 2, 5, and 8 of Regulation 289 of 2006. The amendment affects the structure and organization of the ALUIIZC. According to it, the ALUIIZC will have a Tirana-based central department and 27 local departments according to the list introduced by it. Further, the ALUIIZC will be chaired by the General Director and 3 (three) Deputy Directors.
