The approval of the 2004 Forest protection and Development Law was a milestone which marked the legal recognition of community forestry in Viet Nam. Yet, general understanding of community forests as only the area legally allocated to village communities has undervalued the role of community forestry. To address this issue, it is recommended that community forestry needs to be clearly defined in the forestry legal framework to include forest areas allocated to individual households, particularly natural forest areas where collective forms of forest management are being practiced.

A lack of respect for the role of local people in land use planning and local farming traditions have led to the encroachment of forest land in many areas in Viet Nam, hindering the sustainable management of forest resources. Based on a review and assessment of overlapping forest land boundaries, and taking into account local customs, this brief offers a solution to this challenge. For any solution to work, it is important to ensure the active participation of local people in implementing land use planning and land allocation.

Local communities and state forest actors, such as Protection Forest Management Boards (PFMBs), State Forest Companies (SFCs), play equally important roles in forest resource management. Yet local communities have limited legal rights. This is one reason that leads to a lack of forest ownership for local communities. In order to support local communities to effectively engage in sustainable forest management and livelihood development, a fuller set of rights should be legally given to them.

Farm incomes in rural Vietnam are tightly constrained by very small farm sizes. Stringent limits on the area of cropland that individuals may own means that farmers need a well‐functioning rental market to consolidate land parcels, grow their farm enterprises, adopt new technology and increase incomes. This research investigates the efficiency and equity impacts of the rental market in rural Vietnam and attempts to identify transaction costs impeding the market.
